[5 A.D.2d 296 Page 297] In this personal injury action, defendant appeals from an order denying his application for a change of venue from Bronx
County to Sullivan County. The action arises out of an accident which occurred in Woodbourne, Sullivan County, in which the
infant plaintiff was struck by an automobile owned and operated by the defendant, a resident of Ulster County. The instant
action was instituted in Bronx County where the plaintiffs reside. After the commencement of the action, pursuant to section
187 of the Civil Practice Act, defendant moved to change the venue thereof to Sullivan County, where the occurrence took place,
on the ground that the convenience of witnesses and the ends of justice will be promoted by the change.
