St. Maries Plywood, appellant employer, appeals from an order of the Industrial Commission granting claimant respondent Parker unemployment compensation benefits. The employer contends that the commission erred (1) in placing the burden of proof on the employer to establish that the employee was discharged from his employment for misconduct; (2) in concluding that the employees threats to fellow workers and to the employers plant did not constitute "misconduct" within the meaning of the Employment Security Act; and (3) in concluding that threats made by the employee after he was ordered to stop threatening his co-workers did not constitute employee misconduct.
